ORDINANCE NO. 2007-08

AN ORDINANCE AMENDING CHAPTER VII, ARTICLE 8.13 OF
THE VILLAGE OF
TANGLE WOOD CODE OF ORDINANCES PROVIDING FOR THE REGULATION OF GOLF
CARTS AND ALL-TERRAIN VEHICLES

WHEREAS, the Village Board of Aldermen believes it is in the public interest to add provisions to the Lake Tanglewood Municipal Code; and

WHEREAS, the Village is acting after receipt of a duly reviewed and approved requests from the Village Police Department; and

WHEREAS, the Village desires to regulate and preserve the health, safety, and welfare of the residents of Lake Tanglewood

NOW THEREFORE BE IT ORDAINED by the Board of Aldermen of the Village of Lake Tanglewood that Chapter VII, Article 8.13 of the Code of Ordinances, Village of Lake Tanglewood, Texas, is hereby amended by adding the following regulations to the Village Code of Ordinances to read as follows:

Article 8.13 - a. All-terrain vehicles

1.    Number of riders per vehicle is limited to how the vehicle is equipped for seating.

2.    Riders under the age of 21 shall wear a helmet

3.    The rider will yield to all other traffic

4.    All A.T.V's must be properly muffled

5.    Hours of operation for Youth operators shall be from sunrise until 30 minutes prior to

sunset. Adult operators, shall be from sunrise until 30 minutes prior to sunset exception: vehicle is equipped with head and tail lamps, may operate after sunset.

b. Golf Carts will be allowed to drive on Corporation roads and shall be operated safely at all times.

1. The number of riders is limited to how the golf cart is equipped for seating, no more than 3 in front seat, if equipped with rear seat (2)

2. All passengers will be seated

3. Youth under 13 years of age will not be permitted to drive golf carts on corporation roads under any circumstance,(exception: permitted with adult in golf cart)

A.  Youth, ages 13 thru 16 will be required to take the golf cart operator certification class conducted by the Village Police Department

B.     A youth operator must have in his/her possession a certification card issued by the Village Police Department

4. Any golf cart operated will have a rear-view mirror and must display a flag.

5. Hours of operations for youth operators are from sunrise until 30 minutes prior to sunset only

A. Operators will obey all traffic regulations and will yield to all other traffic

B. If approached from the rear; the operator will pull over to the right and let the vehicle pass

6. Operators 16 years of age or older are permitted to operate golf carts safely

A.     If golf carts are to be driven at night they shall be equipped with front and rear lamps and a flag.

B.     During nighttime driving, operators will obey all traffic regulations and if approached from rear will pull over to the right and let other vehicle pass

C.    Utility Vehicles (Mules, Gator Polaris etc.) will be allowed to be driven on Corporation roads and must be operated safely at all times.

1.   All passengers will be seated

2.   Operators must be 16 years of age or older
